August 23d A. D. 1888
In the matter of the Will of David Langel, Deceased.
Be it remembered that heretofore to-wit: On the 15th day of August A. D. 1888, an instrument of writing, purporting to be the last Will and Testament of David Langel, late of Violet Township, in this County, deceased, was produced in this Court and on the same day an application to admit the same to Probate and Record as the Last Will and Testament of said deceased, was filed in said Court, when the hearing of said application was continued to this day at the hour of 11 o'clock, A.M., at which hour the same came on to be heard. And it appearing to the Court here that notice of the filing of said application and of the time set for hearing the same had been given to the next of kin of the Testator, resident, of the State of Ohio, as required by law and the former order of this Court, which service is by the Court approved, the same came on to be heard on testimony. Thereupon came Isaac N. Carnes and one of the subscribing witnesses to said instrument of writing, who being duly sworn in open Court testified to the due execution and attestation of said instrument of writing which testimony was reduced to writing and by him signed in open Court. And also came J. R. Snyder who being duly sworn says that he was well acquainted with Henry Langel one of the subscribing witnesses, to said will, who is now deceased, and with the hand writing of said Henry Langel, having often seen him write, that the signature "Henry Langel" as subscribing witness to the last will and testament of said David Langel deceased is the signature of of [sic] said Henry Langel and is in his own handwriting. Whereupon the Court find that the aforesaid instrument of wriing [sic] is the Last Will and Testament of said David Langel, deceased. That the same was duly executed and attested, and that the said Testator, at the time of making and signing said Will, was of full age, of sound mind and memory and not under any restraint. It is, therefore, by the Court ordered, that the said instrument of writing be admitted to Probate as the Last Will and Testament of the said David Langel, deceased, and that the same and all the testimony thereto, and the proceedings had thereon, be entered of record in this Court.
J. T. Busby, Probate Judge
